These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Kyoros ("Company", "we", "us", or "our"), concerning your access to and use of the https://kyoros.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). The Site provides an online platform for the following goods, products, and/or services: VPS hosting services and cloud infrastructure (the "Platform Offerings"). In order to help make the Site a secure environment for the purchase and sale of Platform Offerings, all users are required to accept and comply with these Terms of Use.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

How buying services works

1. What you're buying:

1. VPS Hosting: When you buy a service, you acquire the right to use that hosting service; you're not actually acquiring the physical server itself. What you get includes a license directly from us to use that service. Services are subject to specific terms of use, and these terms are the 'license' that we set on Kyoros. This license also applies to you if you download a service that someone else has bought for you.
2. Technical Support: We offer technical support for certain services. If we choose to support a service, this will be identified on the service page. All supported services include a support period. Your right to access Technical Support requires an Kyoros account.
3. Infrastructure Services: In addition to the use of the platform, when you 'buy' a service you also receive infrastructure services from Kyoros like 24/7 customer support, fraud protection, service quality control and other related infrastructure services.

2. The total price for a service on Kyoros is made up of:

1. Service price: The service price is made up of a license fee (for the license you choose for the service), and if relevant the technical support fee (for supported services).
2. Setup fee: This is the fee for the setup services you get from Kyoros.
3. Additional services: In some transactions on Kyoros the total price may include additional service fees like extended backups, advanced monitoring, etc.
4. Taxes: Some transactions on Kyoros may be subject to tax that may be added to the price. See the tax section for details about taxes on Kyoros.

User Responsibilities

The user agrees to use the services legally and in accordance with best practices. They are responsible for the security of their data and access, proper configuration of their services, and compliance with applicable laws and regulations in their jurisdiction.

Payment Terms

Services are billed monthly or annually depending on the chosen subscription. Payment is due in advance and automatically charged according to the agreed terms. In case of non-payment, services may be suspended after notification.

Termination

These terms may be terminated by either party with 30 days notice. In case of violation of the terms of use, we reserve the right to immediately suspend services after appropriate notification.

Limitation of Liability

Our liability is limited to the amount of sums paid for the service concerned in the last 12 months. We cannot be held responsible for indirect damages, loss of profits, or business interruption.
